What is the difference between Terms & Conditions and a Privacy Policy?
Terms & Conditions govern how people use your website (the rules). A Privacy Policy explains what data you collect and how you handle it (the disclosure). Most websites need both.
Are Terms of Service legally binding?
Yes โ€” when properly presented and accepted. To be enforceable, the user must have a clear opportunity to read and agree (e.g. a checkbox on signup or checkout). Just linking from the footer is weaker; explicit consent is stronger.
Should I use a template or hire a lawyer?
A template gets you 80% of the way and is fine for low-risk content sites. For SaaS, ecommerce above ยฃ10k/month, or any business handling sensitive data, hire a solicitor to review or draft custom terms.
How often should I update my terms?
Update whenever you launch a new product, change your refund policy, add new payment methods, or expand to a new region. Notify users of material changes (email or banner) before they take effect.
Do I need separate terms for different products?
Usually one set of master terms is enough, with product-specific addendums where needed (e.g. care plan SLA, subscription cancellation rules).
